These Terms & Conditions ("Terms") govern your use of ScholarMind ("Service"), operated by Scholarmind ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. The Service

ScholarMind is an AI-assisted academic writing platform that helps users plan, draft, analyze and reference Master's and Doctoral theses. The Service is provided on a prepaid credit basis (one-time purchases of credit packs).

2. Acceptance & Eligibility

By using the Service you confirm that you are of legal age in your jurisdiction and, if acting on behalf of an organization, that you have authority to bind it. Continued use of the Service constitutes acceptance of these Terms.

3. Account & Credentials

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it up to date.

4. Acceptable Use

You agree not to misuse the Service. In particular, you shall not:

  • Use the Service for unlawful, fraudulent, or deceptive purposes;
  • Send spam or unsolicited communications;
  • Infringe intellectual property or privacy rights of others;
  • Probe, scan, or test vulnerabilities, or introduce malware;
  • Scrape, reverse engineer, or attempt to circumvent technical limits;
  • Resell, sublicense, or redistribute the Service without our written consent.

5. Generative AI — Specific Rules

ScholarMind uses generative AI to assist with research and writing. You agree to the following:

  • You are solely responsible for your prompts and how you use generated outputs.
  • You must verify the accuracy of any output before relying on it. AI outputs may contain errors, hallucinations, or outdated information and are not a substitute for qualified professional advice (legal, medical, financial, academic supervision).
  • You must ensure you have the rights to any content you submit as input.
  • You shall not generate content that is illegal, harmful, hateful, defamatory, sexually explicit involving minors, deceptive (e.g. deepfakes of real people without consent), or designed to harass or deceive.
  • We reserve the right to filter, refuse or remove outputs and to suspend accounts that violate this section. We also operate a takedown procedure for rights-holder complaints; repeat infringers will be terminated.

6. Intellectual Property

We retain all rights, title and interest in the Service, including software, design, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. As between you and us, you retain ownership of the content you create using the Service, subject to a limited license for us to host and process it solely to provide the Service.

7. Payments, Billing & Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellation and refund mechanics are governed by Paddle's Checkout & Buyer Terms.

8. Service Availability

We do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, the Service is provided "as is" without implied warranties of merchantability or fitness for a particular purpose.

9. Suspension & Termination

We may suspend or terminate your access for: material breach of these Terms, non-payment, security or fraud risk, or repeated/serious violations of our policies. You may stop using the Service at any time. Upon termination, you may export your content within a reasonable window, after which it may be deleted.

10. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or in connection with the Service shall not exceed the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim. We exclude liability for indirect, consequential, special or incidental damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be excluded by law (e.g. fraud, death or personal injury caused by negligence).

11. Indemnity

You agree to indemnify and hold us harmless from claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

12. Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use after the effective date constitutes acceptance.

13. Governing Law

These Terms are governed by the laws applicable at the seller's place of establishment, without regard to conflict-of-law rules. Disputes shall be brought before the competent courts of that jurisdiction.
